Shariah Ruling: Cake & Sweets Offered by Christian on Christmas

NOTE: It should be noted that the below answer is the English translation of the Fatwa issued by Jamia Uloom Islamia Allama Yusuf Banuri Town, Karachi, Pakistan.

Question

Christians celebrate Christmas on 25th December. During the celebration, if a Christian gives a box of sweets or cake to a Muslim what is the ruling regarding eating it?

Answer

Christians celebrate Christmas on December 25, which is their religious festival, and it is not permissible for Muslims to attend their religious festivals and exchange gifts with them on this day. In general, it is not permissible to take a gift from a Christian on Christmas while living in a Muslim country.

However, if by not accepting the gift there is a fear of trouble or on the basis of expediency it is permissible to accept it and if the thing itself contains halal ingredients (such as sweets, cakes, etc.) then it is permissible to eat it, and it will not be haraam but it is still better to give it to a needy afterward.

“قَالَ – رَحِمَهُ اللَّهُ -: (وَالْإِعْطَاءُ بِاسْمِ النَّيْرُوزِ وَالْمِهْرَجَانِ لَا يَجُوزُ) أَيْ الْهَدَايَا بِاسْمِ هَذَيْنِ الْيَوْمَيْنِ حَرَامٌ بَلْ كُفْرٌ، وَقَالَ أَبُو حَفْصٍ الْكَبِيرُ – رَحِمَهُ اللَّهُ -: لَوْ أَنَّ رَجُلًا عَبَدَ اللَّهَ خَمْسِينَ سَنَةً ثُمَّ جَاءَ يَوْمُ النَّيْرُوزِ، وَأَهْدَى لِبَعْضِ الْمُشْرِكِينَ بَيْضَةً يُرِيدُ بِهِ تَعْظِيمَ ذَلِكَ الْيَوْمِ فَقَدْ كَفَرَ، وَحَبِطَ عَمَلُهُ، وَقَالَ صَاحِبُ الْجَامِعِ الْأَصْغَرِ: إذَا أَهْدَى يَوْمَ النَّيْرُوزِ إلَى مُسْلِمٍ آخَرَ، وَلَمْ يُرِدْ بِهِ التَّعْظِيمَ لِذَلِكَ الْيَوْمِ، وَلَكِنْ مَا اعْتَادَهُ بَعْضُ النَّاسِ لَايَكْفُرُ، وَلَكِنْ يَنْبَغِي لَهُ أَنْ لَايَفْعَلَ ذَلِكَ فِي ذَلِكَ الْيَوْمِ خَاصَّةً، وَيَفْعَلُهُ قَبْلَهُ أَوْ بَعْدَهُ كَيْ لَايَكُونَ تَشَبُّهًا بِأُولَئِكَ الْقَوْمِ، وَقَدْ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : «مَنْ تَشَبَّهَ بِقَوْمٍ فَهُوَ مِنْهُمْ»، وَقَالَ فِي الْجَامِعِ الْأَصْغَرِ: رَجُلٌ اشْتَرَى يَوْمَ النَّيْرُوزِ شَيْئًا لَمْ يَكُنْ يَشْتَرِيهِ قَبْلَ ذَلِكَ إنْ أَرَادَ بِهِ تَعْظِيمَ ذَلِكَ الْيَوْمِ كَمَا يُعَظِّمُهُ الْمُشْرِكُونَ كَفَرَ، وَإِنْ أَرَادَ الْأَكْلَ وَالشُّرْبَ وَالتَّنَعُّمَ لَايَكْفُرُ”.
